BUT WHAT IS FRANCHISING?
Franchising is a form of contract not directly recognized by the Italian civil code and therefore defined as atypical. This does not mean that it does not find regulation in the Italian legal system, as the art. 1 of Law 129/2004 deals precisely with franchising. First of all, the so-called franchisor is the owner of a brandwhich grants the use of the same to another subject, defined as a franchisee, who can use this trademark to be able to sell products or services. The phase of the sale of products and services by the franchisee can only be carried out in the methods and with the means established by the franchisor. The latter will naturally obtain economic benefits from this agreement, as the franchisee will have to pay him commissions on the rights granted, called franchisor fees, based on the sales made.
